1. Acceptance of Terms
By accessing or using BONE ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App. BONE is operated by Spamrisk LLC ("we," "us," or "our").
2. Eligibility
You must be at least 18 years old and legally able to form a binding contract. You must provide accurate, current, and complete information during registration and keep it updated.
3. Dog-First Profiles & User Content
BONE profiles feature dogs, not people. Public owner photos are not permitted and will be removed. You are responsible for any content you post and for your interactions with other members.
User imagery is not verified by BONE. All photos, videos, clips, and other media you upload are your sole responsibility. We do not verify, endorse, guarantee the accuracy of, or assume liability for user-uploaded imagery. We may review and remove media that violates these Terms or our community standards, including any images containing humans, but we are not responsible for the content members choose to share.
4. License You Grant to BONE
By uploading photos, videos, clips, or any other media to BONE, you grant Spamrisk LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, display, reproduce, distribute, modify, and promote your content within the App and in our marketing and promotional materials. You represent and warrant that you own or have all necessary rights and permissions to share everything you upload. This license continues for as long as your content remains on BONE and may persist in marketing materials that were published before you deleted the content or your account.
5. Membership & Payments
We offer free and paid membership tiers. Paid plans are billed on the schedule shown at checkout. All fees are non-refundable unless required by law or stated otherwise.
6. Prohibited Conduct
You may not harass, threaten, deceive, or share another member's private information without consent. You may not post illegal, harmful, or hateful content. We may suspend or terminate accounts that violate these rules.
7. Termination
You may stop using the App at any time. We may suspend or terminate your account if you breach these Terms or if your conduct threatens the safety or integrity of the community.
8. Disclaimers
BONE is provided "as is." We do not guarantee that every match will be safe, compatible, or successful. Always meet in public places and follow our safety guidelines. We are not liable for the actions of our users.
9. Arbitration Agreement & Class Action Waiver
Agreement to Arbitrate. You and Spamrisk LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the App, or your use of BONE (collectively, "Disputes") will be resolved exclusively through binding individual arbitration, except that either party may seek injunctive or other equitable relief in court for intellectual property or confidentiality matters.
Rules and Forum. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will be held in Miami-Dade County, Florida, unless both parties agree to a different location or to conduct the proceeding entirely by video, telephone, or written submissions.
Class Action Waiver. You agree that all Disputes must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding unless both parties agree otherwise in writing.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to Spamrisk LLC within 30 days of first accepting these Terms. The notice must include your name, address, email, and a clear statement that you do not wish to resolve disputes through arbitration.
Severability. If any part of this arbitration agreement is found unenforceable, that part will be severed and the remaining terms will remain in effect.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use after changes means you accept the updated Terms.
